Medicare HMO

Question
My parents are retired.  My mother's medicare HMO has denied a type of treatment for her arthritis that her Doctor has recommended.  They appealed the denial and are now being told that it could take up to 90 days to arrive at a decision.  Can she sue the HMO for the delay/denial.

You can sue but that will not solve the problem. I would suggest that you find out what the rules are in your state about denials and time limits. I would call the agency that handles insurance and HMO's in your state. Your doctor can also resubmit another request for treatment. Get the medical office on your side. They are the best resource.
